Welcome to Educatively. These Terms of Use (“Terms”) govern your access to and use of educatively.com (the “Site”), including all practice questions, practice exams, explanations, and other content and services available on the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

Educatively provides free practice questions and practice exams for professional certification and licensing exams. You may use the Site for personal, non-commercial study purposes. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of the Site by, any other user.

2. Accounts

Some features, such as saving your practice exam progress, may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when registering and to notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

3. Intellectual Property

All content on the Site, including practice questions, answer explanations, text, graphics, logos, and software, is the property of Educatively or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, republish, scrape, sell, or create derivative works from our content without our prior written permission. Personal use for your own exam preparation is permitted; wholesale copying of question banks is not.

4. Trademarks of Third Parties

All exam names, certification names, and related marks referenced on the Site are trademarks or registered trademarks of their respective owners, including the organizations that administer those exams. Educatively is an independent study resource and is not affiliated with, endorsed by, sponsored by, or approved by any exam administrator, regulator, or certifying body, for any exam we cover now or add in the future. Use of exam and certification names is for identification and descriptive purposes only.

5. Educational Content Disclaimer

Our practice questions are original study materials designed to reflect the topics and style of the real exams, but they are not actual exam questions. We work hard to keep content accurate and current, but we do not guarantee that any content is error-free, complete, or up to date with the latest exam outlines. 6. Prohibited Conduct

You agree not to:

  • Use bots, scrapers, or automated tools to access, copy, or download Site content
  • Attempt to gain unauthorized access to any part of the Site, other users’ accounts, or our systems
  • Interfere with the operation of the Site, including by transmitting malware or overloading our infrastructure
  • Resell, redistribute, or commercially exploit Site content without written permission
  • Use the Site in any way that violates applicable law
  • Circumvent, disable, or interfere with advertising on the Site, or artificially inflate ad interactions

7. Advertising

The Site is supported by third-party advertising, which is what allows us to offer all content for free. Advertisers are solely responsible for the content of their advertisements. The presence of an ad on the Site does not constitute our endorsement of the advertised product or service, and any dealings you have with advertisers are solely between you and the advertiser.

The Site may link to third-party websites, including official exam administrator pages. We provide these links for convenience only and are not responsible for the content, accuracy, or practices of third-party sites.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUCATIVELY AND ITS OWNERS, OPERATORS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY (INCLUDING EXAM OUTCOMES), ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless Educatively and its owners, operators, and contributors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a notice to contact@educatively.com with “DMCA” in the subject line, including: (a) identification of the copyrighted work claimed to be infringed; (b) the URL of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and (f) your physical or electronic signature. We will review and respond to valid notices promptly, including removing infringing material where appropriate.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Site or other users. Sections 3, 9, 10, 11, and 15 survive termination.

14. Changes to the Site and These Terms

We may modify, suspend, or discontinue any part of the Site at any time. We may also revise these Terms from time to time; the updated version will be posted on this page with a new “Last updated” date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the United States and the State of Illinois, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Illinois, and you consent to the jurisdiction of those courts.
